CakeMatch LLC operates CakeMatch, an online marketplace that helps customers discover independent cake makers and helps bakers manage requests, quotes, orders, and payments.
Who these Terms cover
These Terms are an agreement between you and CakeMatch LLC, a Florida limited liability company (“CakeMatch,” “we,” or “us”). You must be at least 18 years old to create an account, request a cake, submit a baker application, or use CakeMatch messaging or payment tools.
If you use CakeMatch for a business, you confirm that you may accept these Terms for that business. Keep your account credentials private and provide accurate, current information.
CakeMatch is a marketplace
CakeMatch helps customers find independent bakers and helps bakers receive requests, quote work, and manage orders. Bakers are independent businesses—not employees, agents, partners, or representatives of CakeMatch.
We do not make, package, transport, deliver, inspect, or guarantee any cake or other baked good. A baker, not CakeMatch, decides whether to quote, accept, perform, cancel, refund, or fulfill an order, subject to the rules in the Baker Agreement and applicable law.
Requests, quotes, and orders
A customer request is not a purchase. A baker quote is an offer from that baker. An order becomes active only when the baker accepts it and the customer completes any required deposit or payment step.
Customers and bakers should keep order details, changes, and important confirmations in CakeMatch messages. Nothing on CakeMatch guarantees a baker's availability, a particular result, an ingredient, an allergen status, a delivery time, or a customer's payment.
Payments and CakeMatch's fee
When a baker offers CakeMatch payment, the customer's payment is processed through the baker's connected Stripe account. CakeMatch collects a disclosed 5% marketplace service fee on the cake price, excluding delivery, from the first deposit for new and unpaid orders. Deposits remain at least 10% of the full quote. The baker receives the remainder through its connected payment account, subject to Stripe's processing and payout rules.
Customers and bakers authorize the disclosed CakeMatch fee when they use that payment flow. Previously paid orders retain the fee recorded when they were paid. The CakeMatch fee is non-refundable when a customer cancels, even if the baker returns some or all of its own portion under the baker's policy. Payments made outside CakeMatch are not verified or protected by CakeMatch, and we cannot investigate or assist with an off-platform payment loss or dispute.
Cancellations, refunds, and chargebacks
Customers may cancel an order directly in CakeMatch. CakeMatch does not review a customer cancellation before it takes effect. The baker's published or communicated cancellation policy determines whether the baker returns any portion of its payment. See our Cancellations & refunds policy for the full marketplace rules.
If a baker cannot fulfill an accepted order, materially fails to deliver as agreed, or cancels an order, the baker must fund a full refund of the customer's payment, including the CakeMatch fee, as required by the Baker Agreement. Card disputes and chargebacks are handled through the applicable payment processor and card network; users must provide accurate information and cooperate with any legitimate inquiry.
Acceptable use and marketplace integrity
Do not use CakeMatch to commit fraud; harass, threaten, or exploit another person; sell illegal goods; misrepresent a cake transaction; submit forged credentials; or arrange conduct unrelated to lawful baked goods. Do not use a CakeMatch match to bypass the platform to avoid the disclosed marketplace fee.
We may restrict, suspend, or terminate an account or listing that creates a safety, fraud, legal, or marketplace-integrity concern. We may investigate suspicious patterns, including repeated matches that appear designed to avoid the platform. Bakers may appeal a strike or removal decision within 10 days; CakeMatch retains the final decision.
Content, reviews, and your responsibility
You keep ownership of the content you post, but give CakeMatch permission to host, display, reproduce, and use it to operate, promote, and improve the marketplace. Only upload content you have the right to use. Reviews must be honest, based on a real interaction or order, and may not be used to retaliate against a baker who declined a request.
We may remove content that is inaccurate, unsafe, infringing, deceptive, or inconsistent with these Terms.
Disputes and Florida law
Before filing a claim, you and CakeMatch agree to try in good faith to resolve the issue by emailing info@gocakematch.com with a description of the dispute and allowing 30 days for an informal resolution.
To the extent permitted by law, unresolved disputes between you and CakeMatch will be resolved through individual binding arbitration rather than a class, collective, or representative action. Either party may bring an eligible individual claim in small-claims court. Claims seeking temporary or permanent injunctive relief, enforcement of intellectual-property rights, or another remedy that cannot lawfully be arbitrated may be brought in state or federal court in Duval County, Florida. Florida law governs these Terms, except where federal law requires otherwise.
Changes and contact
We may update these Terms as CakeMatch changes. The updated date at the top will show when the current version took effect. Continuing to use CakeMatch after a material update means you accept the updated Terms, except where law requires another form of notice or consent.
